@30 your missing the point. He is talking about user content. When you make a video, and you edit it and post it. it is YOUR VIDEO. As for the music, the music is playing while there is acting in the background. Seeing as this is a non profit video they can do nothing.
If you altercate anyones video with your own content, sound, and graphics it is legally yours because it no longer the orignal piece of work produced by that artist as intended.
Now, if he just played the video with Music with no added sound effects or altercation then he could be liable to infringment.

I respect UltraDavid a ton, so I hope there is no disrespect found in this post. This is just my opinion.
The videos in question are all broadcastings of copywritten material. SF4, Blazblue, tekken all this stuff has a copyright and from the best of my knowledge, broadcasters/streamers don't pay any royalties to said holder of material for broadcast usage, which is why Joe Doe gaming can hold a tournament, record and post videos of their own tournament on youtube and not be asked for a dime.
Now I am not sure if their is some sort of payout a Major tournament organization needs to provide to capcom, Namco and such to have their games shown on streams and appear in Tournaments and I really doubt there is since if I had money and equipment I could throw my own tourney without issue.
What this boils down to, is certain tournament organizers what to earn an extra $500 - $5000 (could be less or more)
for advertising on their streams, more viewers more money. But has it really boiled down to this? are we going to really start splitting pennies on our good times?
I know that throwing tournaments cost money, equipment, venue, etc, etc. But I thought this was all done for the joy not the business. Plus don't all tournaments charge a venue fee to pay for all this, every tourney I've been to charges one so that they can recoup their losses slowly but surely, not to mention some of these organizers can at times work out a deal where, if they can get enough heads in the door the venue holder will sometimes waive the fee and or cut the organizer in on some of the proceeds, this is also venue specific, but I know of some TOs who have done this.
I personally uploaded some videos from a tourney I went to, I asked the TO if it was coo, he said yeah and I posted them. About 2 weeks later I find out a player that made top 8 at the tourney really wanted those videos, so he re-uploaded them on his personal channel. I met the player personally around 6 months later and he told me "Thanks" for having the videos and that he had hoped he didn't disrespect me for not having asked person in using "My Videos". I honestly could not care, because it was done for the FGC as well as the TO to get the word out there, the player in question is known 100x more so than I will ever be in FGC but every little bit helps when it comes to adding exposure to the FGC and maybe that is where these TOs need to take a step back and ask themselves. Is it really worth getting angry over losing a tiny bit of money over having an additional 5-10k in viewer exposure? I mean, I'm pretty sure those who are really fans of the FGC saw the official stream while the extra viewers where either to far to get a good connection or there were a few people who knew the "pirate" streamer and from there a few people know those people and so on and so on.
We are after all a community, are we not? don't let petty cash come between us all as Money is the root of all evil.
tbh i hate youtube and the 20 copies of the same video so people can attract views to their pages. One is enough. Upload your own stuff or videos which are previously not on it.
Also sick of pages with hundreds of "added tags" which are not even one bit connected to attract attention, but thats another thing haha
Basically youtube is cack and original, with the other 10% being new, original and decent

I agree with your stance completely. None of these major streamed tournaments have a disclaimer about copyright infringement like DVDs and movies. Also, none of the people who have re-uploaded streams on Youtube have been stupid enough to claim it's their own work or property so what's the problem. I personally have uploaded streams( took them down recently :) ) because majority of my viewers are in other countries where they have terrible internet and couldn't watch the streams. I have even gotten thanks for doing so by some of these players in tournaments because they have been able to study their game play and see their mistakes.
I know that these organizers spend countless hours and personal money organizing these tournaments & getting their equipment ready, but some of this responsibility needs to fall on them and not chastising the Youtubers for uploading them. I can see if they were selling the content on DVD and these channels were taking profit from them. But they are not and these channels are the only way a person can watch a live-stream that they missed. There needs to be a compromise or have these tournament guys post these streams on exclusive channels so that when people break the law, then they will be punished. Get a disclaimer, post the disclaimer frequently during the stream like their ads & people will learn.
